Emergency Rule Changes Regarding ABC Permits

    EMERGENCY RULE CHANGES REGARDING CLOSED BUSINESSES WITH ALCOHOLIC BEVERAGE CONTROL PERMITS

    Pursuant to the Governor’s March 17th Proclamation the Alcoholic Beverage Control has set forth the following Rule Amendments effective immediately and to continue for the next thirty days.

    TEMPORARY EXTENSION OF CLOSED PERIOD FROM 30 DAYS TO 60 DAYS BEFORE BEING PLACED ON INACTIVE STATUS

    In the event a permittee does not conduct business under any permit issued for a period of sixty (60) days, the permit shall be surrendered to the Director and shall be placed on inactive status.  In active status shall commence at the end of sixty (60) days after close of business, regardless of whether the permit is surrendered to the Director.  In any event, for purposes of this Regulation, a business that has been closed for a period of sixty (60) days shall be deemed to be on inactive status.

    TEMPORARILY NEW PERMIT HOLDERS DO NOT HAVE TO OPEN BEFORE PLACING THEIR PERMITS ON INACTIVE STATUS

    Requests for inactive status may be completed by a permit holder after the permit has been issued without the need of opening for one eight (8) hour day.

     

    EMERGENCY RULE CHANGES REGARDING 2020 RENEWAL OF ALCOHOLIC BEVERAGE CONTROL PERMITS – WAIVER OF LATE FEES

    Pursuant to the Governor’s March 17th Proclamation the Alcoholic Beverage Control has set forth the following Rule Amendments effective immediately and to continue for the next thirty days.

    ALCOHOLIC BEVERAGE PERMITS MAY BE RENEWED UNTIL OCTOBER 28, 2020 WITHOUT INCURRING A LATE FEE

    All permits issued by the Alcoholic Beverage Control Division are renewable on or before June 30th of each calendar year for the fiscal year beginning July 1ST.   There will be no assessment of a late fee for those permits renewed after July 1st, 2020.  No permit shall be renewed by the Alcoholic Beverage Control Division for the current fiscal year after October 28th

     

    EMERGENCY RULE CHANGES REGARDING WHOLESALE DELIVERY INVOICE SIGNATURES

    Pursuant to the Governor’s March 17th Proclamation the Alcoholic Beverage Control has set forth the following Rule Amendments effective immediately and to continue for the next thirty days.

    TEMPORARY WAIVER OF INVOICE SIGNATURE REQUIREMENTS

    Each delivery of controlled beverages by a wholesaler shall be accompanied by an invoice of sale bearing the name of the retailer together with a full description of the controlled beverages delivered, the price and terms of sale and the place and date of actual delivery.  One (1) copy of such invoice shall contain the legibly printed first and last name of the individual receiving the delivery. Another copy shall be retained by the retailer.  The wholesaler and retailer shall maintain a file of such copies for a period of three (3) years following the date of delivery.
