On-Premise, non-restaurant permits temporary expansions for outdoor seating

    In an effort to assist businesses, that are operating under a permit issued by the Alcoholic Beverage Control for on-premise consumption of alcoholic beverages, to be in compliance with the COVID19 Emergency Order set out by the Governor and the Directives issued by the Arkansas Department of Health outdoor service areas may be established on a temporary basis.  Requests must be made in writing and contain a drawing of the outdoor service area sought to be under the temporary expansion along with approval from city or county officials.  Such outdoor service areas may not exceed the permitted seating requirements for restaurant mixed drink minimum and maximum permits and boundaries shall be clearly defined by temporary fences, walls or barriers that will constitute a recognized boundary and contain posting with a 5” X 7” sign, at locations to be determined by the Director or Board, stating “NO ALCOHOLIC BEVERAGES BEYOND THIS POINT”.  The boundaries shall be sufficient that patrons may not be able to step over and exit with open alcoholic beverages and no alcoholic beverages shall be removed from the outdoor area except as permitted in an approved entertainment district or otherwise provided for in the Alcoholic Beverage Control rules.  Service of alcoholic beverages in the temporary expansion shall be limited to patrons seated at tables in the approved area between the hours of 10 a.m. and 10 p.m. All Alcoholic Beverage Control rules governing outdoor service areas, not explicitly addressed herein, shall remain in effect as well as all Arkansas Department of Health Directives.  Temporary expansions will remain in effect until the termination of the COVID19 Emergency Declaration by the Governor.
