CDL/CMV Offenses

Statutory Reference: § 27-23-112

Suspension periods for CDL/CMV – DWI/Refused to Test / Other Major Offenses are as follows:

  • 1st Major Offense = 1-year disqualification. Licensee required to re-test for CDL after disqualification period ends. 
  • 1st Major Offense transporting hazmat = 3 years disqualification. Licensee required to re-test for CDL after disqualification period ends.
  • 2nd Major Offense = Permanent disqualification of CDL license.

Note: When the offense occurs in a non-commercial vehicle, and, the licensee holds a CDL license, the following will occur:

1) In addition to the disqualification, the licensee would also need to meet the state statutory requirements as described in § 5-65-103.

2) The licensee would also be required to downgrade their license status to meet the § 5-65-103 requirements outlined under the DWI/BWI Alcohol offenses.
