Statutory Reference: § 5-65-304 and § 5-65-310
Suspension periods for Underage DUI//BUI offenses are as follows:
- 1st offense Underage DUI/BUI/Refused to Test = 90-day suspension.
- 2nd offense Underage DUI/BUI/Refused to Test = 1-year suspension.
- 3rd offense Underage DUI/BUI/Refused to Test = 3-year revocation or until age 21, whichever is longer.

Underage DUI/BUI or Refused To Test administrative convictions require the following state statute requirements be completed before the licensee may be reinstated:
- Individual must complete a state sanctioned Drug and Alcohol Education or treatment program. They must submit the “original” signed completion certificate to Driver Control.
- Individual must attend a Victim Impact Panel class and submit a completion certificate to Driver Control for any DUI/BUI/Refused To Test conviction.
- Individual must pay a $25 reinstatement fee. Payments may be made in person at any state Revenue Office, by mail or online at mydmv.arkansas.gov.
- The individual may be issued a Restricted Driving Permit for a period equal to the length of the driver’s license suspension. A Driver Control Hearing Officer will make the determination of eligibility.
- Individual with a “Revoked” license status will be required to pass all phases of the Arkansas Driver’s License Exam.
MIP/Misrep ID – Alcohol
Statutory Reference: § 3-3-203 and § 5-27-503
Suspension periods for Minor in Possession (MIP) / Misrepresentation of ID – Alcohol offenses are as follows:
- 1st Offense MIP/Misrep ID – Alcohol = 60-day suspension.
- 2nd Offense MIP/Misrep ID – Alcohol = 120-day suspension
- 3rd Offense MIP/Misrep ID – Alcohol = 1-year suspension
NOTE: Minor in Possession/Alcohol suspensions for a person under the age of 18 must be ordered by the court. They are not a Driver Control administrative action.

- Individual must pay a $100 reinstatement fee. Payments may be made in person at any state Revenue Office, by mail or online at mydmv.arkansas.gov.
- Individual may be eligible for a Restricted Driving Permit for a period equal to the driver’s license suspension time. A Driver Control Hearing Officer will make the determination.
- Individual with a “Revoked” license status will be required to pass all phases of the Arkansas Driver’s License Exam.
